Ethical & Responsible Use
Using AI responsibly is not just about avoiding legal risk — it is about maintaining trust with the people you work with and serve. These principles apply whether you are using AI as an individual, building AI-assisted products, or deploying AI at work.
When to Disclose AI Assistance
Disclosure norms are evolving and vary by context. The default rule: disclose when there is any reasonable expectation of transparency, or when in doubt.

Bias and Fairness Basics
AI systems learn from historical data — which contains historical biases. When AI is used for decisions that affect people's lives, those biases can be amplified at scale.
High-risk bias contexts
- Hiring and recruitment — AI trained on past hires may perpetuate historical demographic patterns
- Credit and lending — patterns in historical data can encode discriminatory proxies
- Medical triage — underrepresented groups in training data means lower accuracy for those groups
- Legal and sentencing — risk scoring tools have shown racial disparities in several studies
Mitigation practices
- Diverse review panels for high-stakes AI-assisted decisions
- Human override — AI recommends, human decides and bears accountability
- Regular audit of outcomes across demographic groups
- Do not deploy high-stakes AI without understanding what it was trained on
Even if you are not building AI, using AI to assist hiring, performance review, or access decisions makes you responsible for the outcomes. "The AI decided" is not a defence against discrimination law.
Intellectual Property and Copyright
What remains unsettled (2025–2026)
- Who owns AI-generated output? Varies by jurisdiction — in many countries, fully AI-generated work has no copyright owner
- Did training on copyrighted data create infringement liability? Active litigation in the US and EU
- Can AI output reproduce training data? Yes — there is documented memorisation of training content
Practical guidance
- Do not use AI to reproduce substantial portions of copyrighted text you do not have rights to use
- Sending proprietary source code or confidential documents to external AI tools may expose your organisation's IP
- For commercial work, consider whether your AI provider offers IP indemnification (some enterprise contracts do)
- Add meaningful human creative contribution to AI-generated work if you wish to establish copyright in some jurisdictions
Privacy and Consent
- Lawful basis required: processing someone else's personal data using AI requires a lawful basis under GDPR and equivalent laws — consent, legitimate interest, contract performance, or legal obligation
- Third-party data: do not paste another person's private information into an AI tool without their knowledge — their messages, health information, financial situation, or personal details
- Customer data: using customer data in an AI tool that the customer has not consented to is a potential breach of both privacy law and their trust
- Data minimisation: only use the personal data actually needed for the AI task; do not include additional personal context "for context" if it is not required
Not Using AI to Deceive
Some uses of AI cause direct harm to others. These are not edge cases — they are growing problems with real victims.
- Impersonation: creating AI content that pretends to be a real person (voice, video, text) without their consent — harmful to reputation, potentially fraudulent
- Fake reviews and testimonials: generating fake reviews at scale undermines market trust and is illegal in many jurisdictions under consumer protection law
- Synthetic disinformation: using AI to generate false news, fabricated quotes, or misleading narratives at scale — damages public discourse and is increasingly illegal
- Manipulative persuasion: using AI to exploit psychological vulnerabilities at scale (personalised emotional manipulation, targeting addictive tendencies) — harmful and in some contexts illegal
- Disguised AI communication: passing off AI-generated communication as genuine human contact in contexts where the other party would reasonably object
AI and Vulnerable Populations
Extra care is required when AI output reaches people in vulnerable situations.
- Children: AI does not adapt to developmental stage; content, persuasion patterns, and data practices that are acceptable for adults may not be for children
- Mental health contexts: AI chatbots used for emotional support or mental health assistance must not substitute for professional care; risks of reinforcing harmful thoughts are real
- Major financial decisions: people making significant financial commitments based on AI-generated guidance deserve to know the source and its limitations
The Quick Ethics Test
Before publishing or deploying AI-assisted work, ask:
"Would I be comfortable if the people affected by this — the audience, the subject, my employer, a regulator — could see exactly what I did and how AI was involved?"
If the answer is no, that discomfort is information. Pause and reconsider.
